Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ParaCortex mobile application ("App") operated by ParaCortex ("we," "our," or "us"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

The App uses Sign in with Apple and Sign in with Google for authentication. We do not store your name or email address. You are responsible for maintaining the security of your sign-in credentials and for all activity that occurs under your account. Notify us immediately at apps.privacy@dassanayake.name if you suspect unauthorised access.

3. Subscriptions and Payments

Free Tier

Core features of the App are available at no charge.

ParaCortex Pro (Subscription)

Certain premium features are available through a paid subscription ("ParaCortex Pro"). Subscriptions are billed on a recurring basis (monthly or annual, as selected) through the Apple App Store or Google Play Store. All billing is handled by the respective platform — we do not process or store payment information directly.

• Renewal: Subscriptions automatically renew unless cancelled at least 72 hours before the end of the current billing period.
• Cancellation: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
• Refunds: Refund requests are subject to the policies of Apple or Google. We do not control refund outcomes for platform-processed purchases.
• Price changes: We may change subscription pricing with reasonable notice. Continued use after a price change takes effect constitutes acceptance of the new price.

4. AI Features

The App offers AI-assisted task breakdown in two modes:

• On-Device AI (iOS 26 and later, or Android on supported devices such as Pixel 9 series): Processed entirely on your device. No task data leaves your device for this feature.
• Cloud AI (opt-in): When enabled, only the task description you type or dictate is sent to a third-party AI provider. You can disable this at any time via Settings → Privacy & Permissions.

AI-generated suggestions are provided for productivity assistance only. We make no warranty that outputs are accurate, complete, or suitable for any particular purpose. You are solely responsible for how you act on AI-generated content.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the App's servers, networks, or infrastructure
• Use automated tools to access or scrape any part of the App
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

6. Intellectual Property

The App, including its design, graphics, code, and content, is owned by ParaCortex and protected by Australian and international intellectual property laws. These Terms do not transfer any ownership to you. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

Your task content remains yours. We do not claim ownership over the tasks, notes, or data you create within the App.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The App is a productivity tool and is not a substitute for professional medical, psychological, or therapeutic advice. If you are dealing with a medical condition including ADHD, please consult a qualified healthcare professional.

8. Limitation of Liability

To the maximum extent permitted by law, ParaCortex and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.

Where liability cannot be excluded under the Australian Consumer Law (ACL) or other applicable legislation, our liability is limited to the greatest extent permitted — including, where applicable, re-supply of the service or a refund of the amount you paid in the 12 months preceding the claim.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If you are a consumer under the ACL, you may have statutory guarantees that apply to the App.

10. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the App and delete your account at any time via the settings menu. Upon account deletion, your data is permanently removed from our servers.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify you within the App.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
